Terms of Service

These Terms of Service ("Terms") govern your use of the Ospelia website and platform (the "Services"). By creating an account or using the Services, you agree to these Terms.

The Services

Ospelia is a reporting, planning, and AI-suggestions platform for hospitality businesses. It connects to systems you authorize (such as point-of-sale, advertising, analytics, and email platforms) on a read-only basis, and presents reporting, planning tools, and AI-generated insights and content drafts. Ospelia does not execute actions in your connected systems: it does not process payments, modify your POS, publish content, or place orders.

Your account

• You are responsible for the accuracy of the information you provide and for safeguarding your login credentials.
• You control the roles and permissions of people you invite; anything done under your organization's accounts is your responsibility.
• You must have the authority to connect the third-party systems you connect, and your use of those systems remains governed by their own terms.

AI-generated content and suggestions

The Services include automatically generated analysis, recommendations, and content drafts. These are decision support, not professional advice — review them before acting, and review drafts before publishing them anywhere. You are responsible for business decisions made using the Services and for any content you choose to publish.

Subscriptions and billing

• Plans are billed per location, monthly or annually, as described on the pricing page at signup.
• Founding-wave pricing remains in effect while the subscription stays continuously active.
• You may cancel at any time; access continues to the end of the billing period. Fees already paid are non-refundable except where required by law.

Your data

You own your business data. We process it to provide the Services, as described in the Privacy Policy. On cancellation you may export your data, and we will delete it on request, subject to legal retention obligations.

Acceptable use

Don't misuse the Services: no unlawful use, no attempting to access other tenants' data, no reselling the Services without a white-label agreement, and no use of Competitor Radar data in violation of applicable law.

Availability and changes

We work hard to keep the Services fast and available, but they are provided "as is" without warranties of uninterrupted service. We may improve or modify features over time; material reductions in functionality will be communicated in advance.

Limitation of liability

To the maximum extent permitted by law, Ospelia's total liability arising out of the Services is limited to the amounts you paid to us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, including lost profits.

Termination

We may suspend or terminate accounts that violate these Terms. You may stop using the Services at any time.

Changes to these Terms

We will post updates on this page and update the date above; material changes will be communicated to account holders. Continued use after changes take effect constitutes acceptance.
